Terms of Service

These Terms of Service ("Terms") govern your use of the Dusktide mobile application ("Dusktide", "the app"), developed by Rewaive ("we", "us"). By downloading or using the app, you agree to these Terms. For Apple App Store distribution, these Terms serve as the app's End User License Agreement (EULA).

The service

Dusktide lets you mix ambient sounds for sleep, focus, and meditation, save them as panels, and play them locally or via AirPlay/Chromecast. A free tier is available; additional sounds, unlimited panels, and other features require a Dusktide Pro subscription.

Subscriptions

• Dusktide Pro is billed through your Apple App Store account, on the terms shown at the time of purchase (including any free trial).
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel your subscription in your device's App Store account settings — we cannot cancel it for you.
• Payment is charged to your store account at confirmation of purchase and again at each renewal.
• Refunds are handled by Apple or Google according to their own policies, not by us directly.

License

We grant you a limited, personal, non-exclusive, non-transferable license to use Dusktide on devices you own or control, for your personal, non-commercial use, subject to these Terms and the usage rules of the app store you downloaded it from.

Acceptable use

You agree not to: reverse-engineer or decompile the app beyond what's permitted by law; use the app to infringe anyone's rights; interfere with or disrupt the app's infrastructure (including the sound-hosting service); or use the app for any unlawful purpose.

Sound content

The sounds, artwork, and branding in Dusktide are owned by Rewaive or licensed to us, and are provided for playback within the app only. You may not extract, redistribute, or resell them.

Third-party services

Dusktide relies on third-party services to function, including Apple (App Store, notifications, AirPlay), Google Cast (Chromecast), RevenueCat (subscription management), and Cloudflare (sound hosting). Your use of these integrations is also subject to those providers' own terms.

Disclaimer

Dusktide is provided "as is" without warranties of any kind. We don't guarantee the app will be uninterrupted, error-free, or that it will help you sleep, focus, or meditate in any particular way — it's a tool, not medical advice or treatment.

Limitation of liability

To the maximum extent permitted by law, Rewaive is not liable for any indirect, incidental, or consequential damages arising from your use of the app.

Termination

You may stop using Dusktide and delete it at any time. We may suspend or terminate access to the sound-hosting service for use that violates these Terms.

Changes to these Terms

We may update these Terms occasionally; the "Last updated" date above reflects the latest revision. Continued use of the app after a change means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles, unless mandatory consumer-protection law in your country of residence provides otherwise.
